The Washington Department of Licensing (DOL) mandates that real estate brokers in Washington are required to take a law update course at license renewal to ensure they are current on the issues facing licensees practicing real estate within the state. This course covers many important topics that a real estate broker should be aware of such as the latest Washington RCW changes, a reminder of agency duties, the DOL's advertising guidelines, and additional topics.

Topics and Learning Objectives

This course will address the following topics.

  1. Legislative Update
  2. Legal Update
  3. Business Practices Update

Chapter 1: Legislative Update

Recent changes to federal law and numerous federal court decisions have altered the business of residential real estate. This section will focus on recent national issues that affect a licensee’s business, including issues relating to financing, taxes, and closings.

After completing this chapter, you will be able to:

  • recognize the effects that same-sex marriage and domestic partnerships have on real estate in Washington.

  • identify state programs that help first-time home buyers.

  • explain the benefits of the Veterans Administration home loan for active and honorably-discharged military members.

  • review the purpose of a government's long-term comprehensive growth plan and the updated regulations impacting these plans after the passage of Senate Bill 5254.

  • outline several bills that did not pass state legislation such as House Bill 2186 (an increase in excise tax) and Senate Bill 5239 (water availability to support real estate development).

Chapter 2: Legal Update

Real estate brokers have to comply with numerous legal requirements, including licensing laws, fiduciary duties to clients, and the state Consumer Protection Act (CPA). This section will first look at the most common causes of consumer complaints and how those complaints are filed and handled. Then we will look at a few common areas of risk in real estate practice, and how to minimize risk. Last, we will look at three important court cases that fleshed out what the rules are and how the common law, licensing law, and the CPA work together.

After completing this chapter, you will be able to:

  • identify several consumer-driven complaints such as offer presentation timing and incomplete transaction logs.

  • review the Department of Licensing's investigation process.

  • describe the significance of seller's disclosure and buyer beware (caveat emptor).

  • generalize the use of preprinted forms in the broker's practice of real estate law.

  • identify the rights granted to consumers under the Washington Consumer Protection Act (CPA).

Chapter 3: Business Practices Update

This chapter will review several business practices that should be complied with to protect oneself from legal liability such as agency disclosure requirements regarding dual agency, making competent referrals for topics outside of your expertise, and how to draft a proper introductory letter that doesn't potentially violate fair housing regulations. We'll review the advertisement requirements such as how to properly advertise a real estate teams and the DOL's regulations on social media and website promotions. We'll also cover a licensee's employment status as an independent contractor, several tips keeping yourself safe when dealing with new clients, and how to use the Department's online system for license renewal.

After completing this chapter, you will be able to:

  • recognize the structure of real estate teams within a brokerage firm and the advertisement regulations when promoting a team.

  • list the criteria that categorizes an individual as an employee or as an independent contractor.

  • practice several personal safety rules that can help avoid a potentially dangerous situation.

  • review the Department of Licensing's online real estate license renewal system.

  • identify the phrasing that might imply preferences for those protected by discrimination regulations when drafting introductory letters.

  • describe how to handle a situation when more then one offer is submitted to purchase a property.

  • recall that builder contracts may benefit the builder more than the buyer.

  • paraphrase the expected professional conduct when dealing with other licensees.

  • summarize topics that could add to a broker's risk such as expertise beyond your knowledge and dual agency relationships.

  • outline the Department of Licensing's advertisement standards for social media and the DOL's "one-click away" rule.

Course Completion Requirements

The course will take approximately 3 clock hours to complete.

Students must complete all reading assignments and pass incremental assessments to make progress. Students will be logged out of the course if they are not actively engaged with the course for 10 minutes.

Completion of the course requires passing a final examination of 10 multiple choice questions with a minimum score of 70%. Students that fail a final exam may retake the final exam as many times as needed to pass, and a different set of questions will be presented each time the student attempts the exam. Students are required to study for the required clock hours before being able to access the final exam.

After successfully passing the final exam, a course completion certificate will be available for the students to download and keep for their continuing education records.
