This course is designed to give the licensee a comprehensive understanding of the law of agency as it applies to the practice of real estate in today's market. The basic concepts of agency law are presented. The discussion of agency law is based upon both the Common Law concepts of agency and also the California codification and expansion of agency law concepts. The fiduciary duties of the licensee are emphasized.

Attention is also focused on the historical development of agency as it applies to the real estate industry. In this discussion, the concepts of seller representation, buyer representation, and dual agency are examined in the context of modern brokerage practice. The specific requirements of the California Agency disclosure law and procedures are also presented.

The concept of trust funds is discussed along with the rules and regulations relating to the handling of such trust funds. Specific attention is focused on the trust fund account and the liability associated with managing the account.

Particular attention is placed on trust fund violations relating to commingling and trust fund conversion. A detailed discussion of the various types of permitted trust fund accounting records is presented along with suggested good record keeping procedures.

Since the majority of California Department of Real Estate (DRE) audit violations relate to trust funds, a great deal of attention is focused on the DRE audit and the possible penalties for violation of the California Real Estate Law and the Commissioner's Regulations relating to trust funds.

Finally, the student is presented with a series of trust fund transactions in the form of a case study. The case study outlines the various steps in properly recording the trust fund transactions and demonstrates how the transactions are entered on DRE columnar system forms. Once a student has completed this course, a working knowledge of trust fund handling and record keeping requirements will assist the student in staying in compliance with the California trust funds laws.

Brief Course Description

In 2021, the California legislation passed a requirement for all real estate licenses to participate in a Fair Housing course that covers state and federal fair housing regulations. Besides explaining fair housing laws relating to the sale and rental of real estate, the course is required to include an interactive participatory component where the licensee shall role play as both a consumer and real estate professional.

This course will describe selected federal and state civil rights and antidiscrimination laws relating to real property transactions and business establishments. We'll cover the historical impact of fair housing regulations on minority members of our community, describe the primary laws regulating licensee conduct and real estate transactions, and review relevant subtopics including redlining, advertising, refusing to show property, and block busting. Brief Course Description

California real estate law requires responsible brokers to supervise the activities of the salespersons associated with the broker's license. All California real estate brokers who are renewing their broker license must complete a three-hour course on the management of real estate offices and the supervision of real estate licensed activities. The required course is to re-enforce the broker's supervisory role as well as remind the broker of the extra duties that come with the responsibility.

This advanced contract law course builds upon the basic principles of contract law. In this advanced contracts course, the licensee will build upon their basic contract law knowledge to include concepts beyond the basics.
